Terms of Use

These terms are an agreement between you and [COMPANY LEGAL NAME], [REGISTERED ADDRESS] ("we", "us") about your use of the Mimiko app ("Mimiko", "the app"). By downloading or using the app you agree to them. If you don't agree, don't use the app.

What Mimiko is

Mimiko helps you learn Japanese from short clips of YouTube videos with an interactive transcript, dictionary, AI explanations and spaced-repetition reviews.

Eligibility

You must be at least 13 years old (or the minimum age in your country) to use Mimiko. If you are under the age of majority where you live, you may use Mimiko only with a parent's or guardian's permission.

Subscriptions and free trials

• Access requires a subscription. Mimiko's features are available with a paid subscription purchased through Apple's App Store.
• Free trial. Some plans start with a free trial. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you are charged the price shown when you started the trial.
• Automatic renewal. Subscriptions renew automatically at the end of each period (for example, every week or every year) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged within 24 hours before the renewal.
• Cancelling. You can manage or cancel your subscription at any time in iOS Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Deleting the app or your Mimiko account does not cancel a subscription.
• Payments and refunds are handled by Apple under its terms. We cannot issue refunds; you can request one from Apple at reportaproblem.apple.com.
• Price changes. If we change a subscription's price, Apple will notify you as required and, where the law or Apple requires it, ask for your consent before the new price applies.

Videos and third-party content

• Videos are played through YouTube's embedded player and remain the property of their creators. We don't own them and don't charge for them; your subscription pays for Mimiko's own features: the interactive transcript, dictionary, AI explanations, reviews and progress tracking.
• Watching videos is subject to the YouTube Terms of Service and the Google Privacy Policy.
• A video may become unavailable at any time if its owner or YouTube removes or restricts it. We are not responsible for the content of videos made by others.
• Creators who want their videos removed from Mimiko can email hello@mimikoapp.com and we will remove them promptly.

AI explanations and learning content

Explanations, translations, readings, example sentences and difficulty levels are produced with the help of automated tools, including AI, and dictionary data. They can contain mistakes. Use them as a learning aid, not as an authoritative source.

Dictionary data comes from JMdict and KANJIDIC2 (© Electronic Dictionary Research and Development Group, CC BY-SA 4.0), stroke order from KanjiVG (© Ulrich Apel, CC BY-SA 3.0) and example sentences from the Tatoeba project (CC BY 2.0 FR). Those licenses apply to that data.

Your account and data

Signing in with Apple is optional and lets you back up and restore your progress. You can delete your account at any time in the app (Profile → Delete account). How we handle your information is described in our Privacy Policy.

Acceptable use

You agree not to:

• copy, scrape, resell or redistribute the app's content, transcripts or data;
• reverse-engineer the app or its servers, except where the law allows it;
• access our servers other than through the app, overload them, or try to get around subscription checks or usage limits;
• use the app to break the law or anyone's rights.

We may limit, suspend or end your access if you break these terms.

Our rights

The app, its design, software and our own content are owned by us or our licensors and protected by law. We give you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the App Store's Usage Rules. These terms don't transfer any ownership to you.

Changes to the app and to these terms

We are constantly improving Mimiko and may add, change or remove features. We may update these terms; if the changes are significant, we will tell you in the app. Continuing to use Mimiko after the changes take effect means you accept them.

Disclaimers

Mimiko is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise that the app will be uninterrupted, error-free, or that any particular video will remain available, or that using it will lead to any particular learning result.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to Mimiko is limited to the amount you paid for it in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, and if you are a consumer, you keep all rights your local consumer law gives you.

Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app (including product liability, legal compliance or intellectual-property claims). If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You confirm that you are not in a country subject to a U.S. Government embargo and are not on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of [GOVERNING LAW / COUNTRY], except where your local consumer law requires otherwise. Disputes will be resolved by the courts of [JURISDICTION], unless your local law gives you the right to go to court where you live.
